CPWC NEWS NETWORK – USER AGREEMENT & TERMS AND CONDITIONS

Effective From: December 2025
This User Agreement (“Agreement”) governs your access to and use of CPWC News Network (“Platform”), operated by Climate & People Welfare Council (CPWC), a Section 8 non-profit organisation registered in India.
By creating an account or submitting content, you (“User”, “You”, “Your”, “Organisation”) agree to be legally bound by this Agreement.
If you do not agree, you must not use the Platform.
By clicking “I Agree”, you acknowledge that you have read, understood, and unconditionally accept all terms stated below.
1. Eligibility & Authorisation
1.1 You confirm that you are an authorised representative of the organisation creating the account.
1.2 All registration details provided (including name, email, designation, organisation name, etc.) are true, complete, and verifiable.
1.3 You agree to promptly update your details if any information changes.
1.4 You confirm that you are at least 18 years of age and legally competent to enter into this Agreement.
2. Nature of the Platform
2.1 CPWC News Network is a public-information, press-release, and announcement distribution platform.
2.2 The Platform does not:
verify or fact-check claims submitted by users
investigate or authenticate content
endorse or certify any statements
guarantee accuracy, legality, or completeness
provide editorial or journalistic services
2.3 All liability and responsibility for submitted content rests solely with the User.
3. Responsibility for Author-Verified Content
By submitting content, you confirm that:
3.1 All content is author-verified, factual, lawful, and approved by your organisation.
3.2 No content contains false, misleading, fabricated, manipulated, or deceptive material.
3.3 You possess all rights, licences, and permissions for any media included (logos, images, videos, documents).
3.4 You accept complete legal responsibility for all published content.
4. Prohibited Content
You agree not to submit content that includes:
False, misleading, deceptive, or unverified statements
Defamatory, hateful, abusive, or harmful language
Pornographic, violent, or illegal material
Copyrighted content without proper permission
Personal or sensitive data without consent
Election-related content violating Indian laws
Promotion of gambling, drugs, scams, or illegal activities
AI-generated or synthetic content misrepresented as factual
Content harmful to environment, climate, or community welfare
CPWC may remove such content at any time, without notice or explanation.
5. Legal Compliance
You are solely responsible for compliance with all applicable Indian laws, including but not limited to:
Information Technology Act, 2000
Intermediary Guidelines & Digital Media Ethics Code Rules, 2021
Copyright Act, 1957
Indian Penal Code
Consumer Protection Act, 2019
Data protection and privacy obligations
Any industry-specific or domain-specific regulations
CPWC bears no responsibility for your compliance failures.
6. Platform Rights & Editorial Discretion
You acknowledge and agree that:
6.1 CPWC may accept, reject, delay, hide, edit, or remove any content at its sole and absolute discretion.
6.2 CPWC is not obligated to publish any submission, whether paid or unpaid.
6.3 CPWC may edit formatting for layout and consistency (without altering meaning).
6.4 CPWC may suspend or terminate accounts for violations or misuse.
6.5 CPWC’s decisions regarding content and accounts are final, binding, and non-contestable.
7. No Liability & No Endorsement
7.1 All responsibility for submitted content lies solely with the User.
7.2 CPWC News Network and CPWC shall not be liable for:
false or misleading information
disputes, complaints, legal claims, or damages
losses resulting from reliance on published content
third-party republication, indexing, or sharing
7.3 Publication of content does not constitute endorsement, approval, or verification by CPWC.
8. Intellectual Property
8.1 All submitted content remains the intellectual property of the submitting organisation.
8.2 By submitting content, you grant CPWC a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable licence to:
host
display
publish
index
store
archive
share
distribute
8.3 This licence continues even after account deletion or content removal requests.
8.4 All Platform structure, layout, categories, code, text, and design are the exclusive property of CPWC.
9. Indemnity (Strong Legal Protection Clause)
You agree to fully indemnify, defend, and hold harmless:
CPWC News Network
Climate & People Welfare Council (CPWC)
Their officers, directors, staff, volunteers, and representatives
from any and all claims, damages, penalties, liabilities, costs, or legal fees arising from:
Your content or submissions
Your organisation’s actions
Breach of this Agreement
Legal notices, complaints, or litigation
Any violation of law
This indemnity is unconditional and survives indefinitely.
10. Account Suspension & Termination
Your account may be suspended or terminated immediately and without notice if:
Prohibited content is submitted
Registration information is false
Repeated violations occur
Fraud, misuse, or unlawful activity is detected
CPWC determines action is necessary for compliance, safety, or integrity
CPWC is not required to justify or explain such decisions.
11. Content Removal
Content may be removed due to:
Policy violations
Legal notices or government orders
Complaints by affected parties
Intellectual property claims
Platform standards or community welfare concerns
Internal moderation decisions
No refunds shall be provided for removed paid submissions.
12. Grievance Redressal
For concerns, complaints, or takedown requests, contact:
Responses will be provided in accordance with applicable legal timelines.
13. Modifications to Terms
CPWC may revise or update these Terms at any time.
Continued use of the Platform constitutes acceptance of the updated Terms.
14. Governing Law & Exclusive Jurisdiction
This Agreement shall be governed exclusively by the laws of India.
All disputes shall fall under the sole and exclusive jurisdiction of the competent courts located in Jaipur, Rajasthan, India.
No other court or jurisdiction shall have authority.
FINAL ACCEPTANCE
